Chief Justice Roberts says courts will examine protections against sexual harassment......

Chief Justice John G. Roberts Jr. announced an initiative Sunday to ensure there are proper procedures in place to protect law clerks and other court employees from sexual harassment, saying it is clear that the federal judiciary “is not immune” from a widespread problem.

The statement, in Roberts’s 2017 State of the Judiciary Report , follows the retirement last month of Judge Alex Kozinski of the U.S. Court of Appeals for the 9th Circuit. The influential 67-year-old judge stepped down after two reports in The Washington Post detailed allegations he had subjected former law clerks and other women to inappropriate sexual behavior.

“Events in recent months have illuminated the depth of the problem of sexual harassment in the workplace, and events in the past few weeks have made clear that the judicial branch is not immune,” Roberts wrote.

“The judiciary will begin 2018 by undertaking a careful evaluation of whether its standards of conduct and its procedures for investigating and correcting inappropriate behavior are adequate to ensure an exemplary workplace for every judge and every court employee.”

Just days after Kozinski’s Dec. 18 retirement, Roberts directed James Duff, director of the Administrative Office of U.S. Courts, to put together a working group to examine the issue. CNN reported at the time that Duff will report back by May 1.

A group of nearly 700 former and current law clerks also sent Roberts a letter requesting action and asking that he highlight the concern in his annual report on the state of the federal judiciary.

“I have great confidence in the men and women who comprise our judiciary,” Roberts wrote. “I am sure that the overwhelming number have no tolerance for harassment and share the view that victims must have clear and immediate recourse to effective remedies.”

Of particular concern has been the relationships between judges and their law clerks — usually recent law school graduates whose careers are significantly boosted by a year working with a federal judge, particularly on one of the 12 courts of appeal.

An appeals court judge usually has four clerks and a secretary, and the chambers operate independently and under a strict code of confidentiality. Some of the clerks who eventually talked to The Post about their experiences with Kozinski had wondered whether that confidentiality meant they could not report their experiences.

There is a natural reluctance to complain about a judge instrumental to their futures, the clerks said, and it was even unclear as to whom such reports would be directed.

Food for thought:

Wow…  So “Whom would such reports be directed?,” is a good question!!!

This is like begging the question,
“Who will further investigate complaints of sexual harassment, rape and other complaints of Civil Rights violations in the Armed Forces?!”   Independent of the military’s internal investigators, and it's CORRUPTED Judge Advocate General Corps, whose job is to protect the chain of command, not prosecute them!!

I say this, as KEY politicians and Women Right’s Advocacy groups continue to push the agenda for women to serve on the Front Line in Combat, as well as fully integrating Transgenders to serve in the military.    Which may only serve a purpose now, but what happens when they decide to "switch gender roles" (identity) later on, and the quotas (working positions) become disproportionate?!

Let’s not fool ourselves,  to think that these young girls-guys will not be sexually assaulted or raped, especially as more and more “mentally challenged” and extreme segregationists are being recruited during this Era of America's Equality Movement.

On the outside looking in, as we await the final aftermath, and more cases of military Rape and Sexual Assault are reported to Congress, “Both sides of the House will finally agree,“I told you so!!”

Yet, my Sexual Harassment, Discrimination and Retaliation Civil Action case was a clear enough answer to “Who has authority over the military?!”

This is why I’ve yet to pursue filing a new petition in the Federal District Court...  In the Navy’s response to Judge Collyer’s Remand Order, that I received in August, they all but admitted their incompetency of mishandling my case, from beginning to the end, yet challenged me to file a new petition.

After watching the Transgender Civil Action case play itself out in Federal Court, I’m truly convinced that Congress and our Federal District Court allows the military to be in charge of itself!!    So why waste my energy?!   It was never about the money!!!  I'm a woman of principle!!   And to not consider Human Rights Protection within our Workplaces, while pursuing Equality in the workplace, speaks volumes of our "So Called Leaders, on Capitol Hill!!"    While Fighting for Justice in my Case, I've been able to see how our court systems and Congress are tightly interwoven!!   And I'm appalled at how they have lost focus!!

Yet in the misogynistic culture, that serves as the backbone of our society, we have lost our sense of morality, and our duty and responsibility, to not only properly mentor our younger generation, as they join the ranks of our professional working class; we have also failed to ensure they are provided a workplace that is FREE OF SEXUAL HARASSMENT or DISCRIMINATION of ANY KIND!!

I was young once, and I understand how our kids will “push the limits” (at home and at work) to get what they want, but during my enlisted years in the Navy, we held open forum "General Military Training" at least once a quarter,  to reinforce the Navy’s Core Values.  Over time, the training was reduced to an online survey, as complaints of sexual misconduct increased.

Although I was not considered a “Poster Girl” for Equal Employment, as far as the Pentagon is concerned, in my heart, I believe in Respect towards others,  and Equal Employment Opportunity in the Workplace, Free of Civil and Human Rights violations!!

As we close out this year and reflect back on what needs to be improved upon in America’s society, especially in the workplace, let us be reminded of Dr. King’s vision for Equality, “Injustice anywhere is a threat to Justice Everywhere!!!”

A New Year's "Message" to President Donald Trump.... A Leader of Vision

of Vision

President Donald Trump,
As you sit atop America’s throne,
Let not your Empire, fall like Rome!
As you build your Army to defend our ports,
Do not allow your judgment to be of that of distort
By the craft of negative sorcery of sorts.
As great men have stood long before you,
Allow their legacies to guide all that you do.
As justice seek to prevail,
And Victory is yours to claim,
Hear first the cry of the people,
And not that of a legacy of shame!!

Trump Accused in Court of ‘Extreme Hostility’ to Women in Combat

Bloomberg Politics reported, Women in the U.S. military escalated their legal battle for equal footing in combat units, saying the Trump administration has shown “extreme hostility” toward integrating the armed services.
Almost five years after the Obama administration vowed to end gender barriers, the Service Women’s Action Network alleged in court Monday that Trump set the tone for a retreat when he faulted his predecessor on the campaign trail for pursuing a “politically correct military.” The women say the president’s chief of staff, Marine General John Kelly, and Defense Secretary James Mattis also have shown an “animus toward women soldiers” and promoted their continued exclusion from combat units.
In Monday’s filing, an update to a lawsuit first filed in San Francisco federal court in 2012, the women take aim at an Army and Marine Corps policy of “Leaders First,” which bars junior enlisted women from entering combat battalions until two or more “women leaders” have joined those battalions. The Defense Department “has not provided any justification for a policy that deliberately leads to the isolation and segregation of women, either during training or upon accession to a combat arms unit,” according to the complaint.
The women also blast the Marines over “sex-segregated Basic Training,” saying it relegates females to second-class status.
The administration said last month in a filing that while it’s making “substantial progress on the implementation of females into previously closed units and has no plans to reverse that policy, DoD cannot commit that a policy will never be changed in the future.”
https://www.bloomberg.com/news/articles/2017-12-18/trump-accused-in-court-of-extreme-hostility-to-women-in-combat
Food for thought:  As a former “Mustang” Naval officer, having served 7- years prior enlisted, and 13- years as an officer, in a misogynistic male-dominant working, aboard a number of our confined Naval warships, I’ve never supported women serving on the “Front Line” in Combat, especially during our modern-times, where our social culture is brewing ‘EXTREME WAR AMONGST THE SEXES!!!”
And when I look back on the Pentagon's slow integration policies, I think of the brutal Rape and Murder of PFC LaVena Lynn Johnson!!  Who was one of the military's most extreme "Combat Causalities," and LaVena did not lose her life on the battlefield, she was raped, tortured, and murdered in the base camp!!
As a former officer, who experienced an extreme degree of Civil and Human Rights Violations while serving in the Navy, I’ve stood on the sidelines about this issue while "Fighting for Justice, as a Military Whistleblower."
In August, the Board for Correction of Naval Records, denied my clemency request, after citing over a dozen violations of my Civil Rights, but the BCNR recommended I file a new lawsuit in Federal District Court.  I guess to join the "Crusade!!!"
Over the years, I’ve had a chance to speak with a number of veterans that informed me of the “political agenda" surrounding Women’s Roles in the Military, yet not a single politician has introduced a Bill to guarantee Human Rights Protection for Women or other Minority service members, especially members of the LBGT Community.  As their lives are being “lobbied” to become the next “Pawns” in our Military’s War Games!!
I Pray to God that President Trump stands his Ground on this issue, and that Vice President Pence Supports Him!!!!!
Until there is a policy put in place where Men and Women can work together cohesively, without fear of being harmed, or sexually harassed, assaulted or raped by their fellow colleagues, then this issue needs to be tabled until such Law can be enacted and enforced!!

FOR THE RECORD

By no means am I not a Champion of Women's (or other minorities) Equal Rights, or the senior advancement of women in the corporate workplace, especially as we continue to thrive in such fields as science, technology, medicine, education, law enforcement, military, etc.

What I'm  appalled by the most is bullying of other women to get ahead!!!!!

Take my prosecution, as a military whistleblower for example....

The initial prosecutor and legal advisor to my former boss, who'd advised him to prosecute me was, in fact, a woman!!!   Navy JAG officer, former Lt. Commander Mei-Ling Marshall.

During her testimony, which is documented in my Record of Trial, and is public record, she openly admitted that she had a personal interest in the outcome of my trail!!

This was due to the fact that as she was being considered for promotion to the rank of commander, "her personnel record was flagged."

Prior to her testimony, she'd learned that I reported her to the Navy IG for blatant acts of Retaliation; as well as tampering of government evidence (erasing  court transcripts of an initial Article 32 preliminary hearing held in mid-2007); witness tampering; forging witness testimonies, and a series of other legal infractions that were not properly investigated by the Navy's EO investigator, Captain Eileen C. Riley, or Navy IG Investigators, Dave Brownell or Tom Sawyer.

Once again, I've sat on the sidelines for several years and watched how Key Women Rights organizations have massed their Armies to stampede the doors of the Oval Office, which is where the final decision lies, to grant the Armed Forces a Human Rights Bill, once and for all; while the Pentagon is campaigning a mass recruitment of Transgenders, "Mentally Impaired" Civilians, and Young Women, to serve on the Frontline in Combat!!

Yet I see this issue as two-fold, if Trump does nothing to resolve this issue, and is ultimately impeached, as Sexual Harassment and Rape claims against him, steady their way to the Justice Department; the decision will rest on the shoulders of Vice President Pence, and the world already knows how he feels about integrating of women to serve in combat roles.  Can you say, "MULAN?!"   But who wants either blood or more cases of rape or sexual assault on their hands?!!!

"Cosmic Seeds".... Live a Life of Love and Divine Purpose...Not a Life of Hate...

Cosmic Seeds
©  2017  Sy’needa Penland

Infinite Beings
Cosmic Seeds of thy Universe
Divine conduits of my Earthly soul
Womb of knowledge and infinite wisdom
Where Divine life unfolds
Allow me to nourish more of your essence
As your lotus unfolds
Stories told
Stories written
Mere characters on my earthly stage
Strife does not exist within
Only Love
For it co-exists with hate
Above my Earthly skin
Where sin is only a gateway
To my inner worlds
As new life begin, again
So shall Divine life
Repeat itself again, and again
And again

My latest poetry piece... "Sweet Georgia"

Sweet Georgia
©  2017  Sy’needa Penland

Sweet magnolia breeze
fills the southern air with the
fragrant essence
of thy fruitful earth.

Honey dew melons
line your vast pastures.
Peach orchards
bask in your glory,
waiting to kiss upon
succulent lips.

Oh my, Georgia’s
sweetest  nectars
that survived her
blood-stained clay.

Year after year,
your peanut farms
exalt seeds
of your greatness.

Heart Healthy,
proclaims Jimmy Carter,
whose legacy has proven
what a proud man he is.
One of Georgia’s finest,
says her history books.

Georgia on my mind,
time and time again,
I pondered about
my home state,
while sailing the
ocean blue.

The Navy broke me in,
introducing me to sin
beyond measure,
while I enjoyed life
on the high seas,
aboard its pleasure boats.

Now my imagination drifts
between old times and new.
As I re-root my essence
in your humble Earth,
I shall appreciate
the joy in you.

Sweet Georgia,
home sweet home.

Abuse of Women in the US Military / Army / Navy - PFC LaVena Johnson - The Silent Truth

CNN reports, "DOJ appeals ruling that transgender people are free to enlist in US military."

(CNN)The Pentagon said it will begin processing transgender applicants to the military on January 1 after a federal judge declined on Monday to put the deadline on hold.

Transgender service members are challenging President Donald Trump's memorandum directing the secretary of defense to bar transgender Americans from military service. The challengers have so far been successful in blocking the President's policy from going into effect while the lawsuit plays out in court. Their latest victory came Monday, when Judge Colleen Kollar-Kotelly ruled that the government would not be "irreparably injured" if the January 1 deadline remained in place as the lawsuit continues.

After the ruling, however, the Justice Department appealed the judge's ruling to a DC-based federal appeals court.

"The government seeks a stay pending appeal of the portion of the injunction concerning accessions," government lawyers said in their brief filed late Monday. They argued that implementing "a significant change" to military standards for the composition of the armed forces even before a court decides the merits of the case would "place extraordinary burdens on our armed forces and may harm military readiness."

Justice Department spokeswoman Lauren Ehrsam said in a written statement: "Plaintiffs' lawsuit challenging military service requirements is premature for many reasons, including that the Defense Department is actively reviewing such service requirements, as the President ordered, and because none of the Plaintiffs have established that they will be impacted by current policies on military service."

Food for thought:  Am I the only one connecting the dots here...  To see that Pentagon officials are preparing to fully integrate members of the “Transgender” community, to serve amongst the ranks of the “mentally unstable,” without full enforcement of Civil Rights Laws, and Human Rights protection?!

Congress, REALLY?!!  What Kool aide are you drinking?!!!

When I challenged my former bosses’ Civil Rights violations against me, in a Civil Action lawsuit, petitioned before the Federal District Court, on the grounds of Whistleblower Retaliation, Sexual and Racial Discrimination, and subsequently Human Rights violations, argued in a pro se motion, I wanted to establish a legal precedent, to send a message to the Defense Secretaries, to UPHOLD THE EQUAL EMPLOYMENT LAWS within ALL Branches of our Armed Forces, especially to ensure the protection of our next generation of fighting warriors!!!

Long before I was conceived, my Civil Rights and Equal Employment Rights were protected, but once I was assigned aboard ships, to work in a majority WHITE MALE environment, with some of the most racist and sexist men on the planet, my life was placed at risk, nearly every day, for 20-years of my young adult life.

I was born and raised in the Deep South and I didn’t truly understand racism or sexism until I joined the Navy!!!!!

My enemy was not on foreign shores!!   My enemy slept next door to me in the berthing compartment.  My enemy walked past me in the passageways aboard the ships. My enemy lived next door to me in the barrack quarters.  My enemy worked alongside me in the WORKPLACE.  I looked into the eyes of my enemy every day, not knowing I was his or her enemy!!  And how I was persecuted at the end of my Naval career speaks volumes!!

With all the negative energy that is surmounting with America’s ongoing protest movements, be it; “The Rise in the Feminists against Sexual Harassment,” “Black Lives Matter” “Water is Life,” “Antifa,” “Dreamers,” and other social-activist groups that I’m not aware of, I’ve yet to hear the Voices of Human Rights Activists, to protest against sending our young girls and boys into harm’s way, to become victims of ongoing  military hate crimes; especially with a pending agenda to allow more women to serve on the front lines in combat.  And I’m sure at the top of the Pentagon’s list are Transgenders!!

WAKE UP!!!!

I enlisted in the Navy, during the Pentagon’s “experiment” to first integrate women aboard ships, and my friends and I endured the worse imaginable incidents involving “bullying, sexual harassment, sexual assault, rape, racial discrimination, and other blatant violations of our Civil Rights, and subsequent Human Rights!!”

Let’s not forget the thousands of female soldiers and marines that were raped and murdered during the Iraqi War.  These are stories that you don’t hear about nowadays, yet the family of PFC LaVena Johnson, reminds us of the tragic realization of sending our young girls into battle and not being told the truth of what really happened to their child, after they are raped and murdered, by the enemy!!

Hear their personal testimony…
https://www.youtube.com/watch?v=yy27jAcsrWY

Statistics have shown that transgenders are the “under-represented” minority class in this country, and they are the ones that need the most Human Rights protection, especially in the Armed Forces!!!!!

Therefore, I am sending a personal plea to our Commander in Chief… President, Donald Trump, to issue an Executive Order for a Human Right Bill, to grant Human Rights Protection of our service members and Veterans, once and for All!!

Before we look back on this page of American history and regret it!!

Real Dangers OF 5G Wireless Radiation

Universe, Save Us, From OurSelves!!!

The Hill reports, "Pentagon starting first-ever financial audit." .... If they are appointing "in-house" auditors, to perform this daunting task, I hope senior prosecutors from the Department of Justice Anti-Trust Division are standing by.... "Yet who knows if they can be trusted!!!!"

Department of Defense (DOD) officials announced Friday that the agency would undergo the first full-scale audit in its history.
Defense Department Comptroller David Norquist said at a press conference that the audit would begin this month.
"It is important that the Congress and the American people have confidence in DOD's management of every taxpayer dollar," Norquist said.
The massive undertaking will examine every aspect of the Defense Department, from personnel and supplies to bases and weapons. At least 2,400 auditors will be tasked with spreading out across the department to examine the Pentagon's estimated $2.4 trillion in assets.
"With consistent feedback from auditors, we can focus on improving the processes of our day-to-day work," Norquist said. "Annual audits also ensure visibility over the quantity and quality of the equipment and supplies our troops use."
He added that beginning in 2018, audits of the Defense Department will be conducted annually as a measure to cut down on waste. Reports will be issued at the end of each year, on Nov. 15.
Norquist also spoke Friday about the danger posed by the looming possibility of a government shutdown. The House passed a two-week spending bill this week that will keep the government running as Congress attempts to pass a long-term spending bill before the end of the month.
"I cannot emphasize too much how destructive a shutdown is," Norquist said Friday. "We've talked before about the importance of maintenance on weapons systems and others, but if it's not an excepted activity, there'll be work stoppage on many of those maintenance functions."
"In the administration's budget, we requested additional money for munitions, and so we would like to increase the production of some of those munitions," he added.
Congressional leaders now have until Dec. 22 to pass another continuing resolution or larger-scale spending bill to avoid a shutdown.
