Presidential Executive Order on Improving Accountability and Whistleblower Protection at the Department of Veterans Affairs

By the authority vested in me as President by the Constitution and the laws of the United States of America, it is hereby ordered as follows:
Section 1.  Purpose.  This order is intended to improve accountability and whistleblower protection at the Department of Veterans Affairs (VA) by directing the Secretary of Veterans Affairs (Secretary) to establish within the VA an Office of Accountability and Whistleblower Protection and to appoint a Special Assistant to serve as Executive Director of the Office.
Sec. 2.  Establishing a VA Office of Accountability and Whistleblower Protection.  (a)  Within 45 days of the date of this order, and to the extent permitted by law, the Secretary shall establish in the VA the Office of Accountability and Whistleblower Protection (Office), and shall appoint a Special Assistant, reporting directly to the Secretary, to serve as Executive Director of the Office.  The VA shall provide funding and administrative support for the Office, consistent with applicable law and subject to the availability of appropriations.
(b)  To the extent permitted by law, the Office shall:
(i)    advise and assist the Secretary in using, as appropriate, all available authorities to discipline or terminate any VA manager or employee who has violated the public's trust and failed to carry out his or her duties on behalf of veterans, and to recruit, reward, and retain high-performing employees;
(ii)   identify statutory barriers to the Secretary's authority to discipline or terminate any employee who has jeopardized the health, safety, or well-being of a veteran, and to recruit, reward, and retain high‑performing employees; and report such barriers to the Secretary for consideration as to the need for legislative changes;
(iii)  work closely with relevant VA components to ensure swift and effective resolution of veterans' complaints of wrongdoing at the VA; and
(iv)   work closely with relevant VA components to ensure adequate investigation and correction of wrongdoing throughout the VA, and to protect employees who lawfully disclose wrongdoing from retaliation.
(c)  In establishing the Office, the Secretary shall consider, in addition to any other relevant factors:
(i)    whether some or all of the functions of the Office are currently performed by an existing VA office, component, or program;
(ii)   whether certain administrative capabilities necessary for operating the Office are redundant with those of another VA office, component, or program; and
(iii)  whether combining the Office with another VA office, component, or program may improve the VA's efficiency, effectiveness, or accountability.
Sec. 3.  General Provisions.  (a)  Nothing in this order shall be construed to impair or otherwise affect:
(i)   the authority granted by law to an executive department or agency, or the head thereof; or
(ii)  the functions of the Director of the Office of Management and Budget relating to budgetary, administrative, or legislative proposals.
(b)  This order shall be implemented consistent with applicable law and subject to the availability of appropriations.
(c)  This order is not intended to, and does not, create any right or benefit, substantive or procedural, enforceable at law or in equity by any party against the United States, its departments, agencies, or entities, its officers, employees, or agents, or any other person.

Department of Veteran Affairs' Whistle-Blowers Are Leery of Trump's Executive Order Creating an Office to Protect Them.

USA TODAY reports, "As President Trump signed an executive order Thursday seeking to provide more protections to whistle-blowers at the Department of Veterans Affairs, the very people he's trying to protect are leery.

In locations spanning from Arizona to Delaware, and Florida to Wisconsin, current and former employees who endured retaliation from superiors after they reported abuses have watched as those managers retained their positions — and were even promoted in some cases.

In Tomah, Wis., a human resources manager is still in place seven years after signing off on punishment for a psychologist who raised concerns about a colleague prescribing too many narcotics at the hospital. The psychologist, Christopher Kirkpatrick, went home and committed suicide.

The hospital later became known as “candy land” because of the prolific prescriptions, and a veteran died there in 2014 from mixed drug toxicity.

The same HR manager did nothing as now-former employee Ryan Honl was stripped of his job duties, locked out of his office and isolated from coworkers a day after he reported fraud and other problems at the Tomah hospital, Honl said. His direct supervisor who initiated the actions in 2014 got a promotion.

"Until there are concrete changes all the way down the chain of command at VA hospitals,” Honl told USA TODAY, “it's all hot air.” 

The order Trump signed creates a new office at the VA that will investigate allegations of misconduct – including retaliation against whistle-blowing employees who reported abuses — and seek to identify systemic barriers that have previously hindered the agency's top leaders from more adequately addressing such problems in the past, including with disciplinary action.

"With the creation of this office, we are sending a strong message: Those who fail our veterans will be held, for the first time, accountable," Trump said. "At the same time, we will reward and retain the many VA employees who do a fantastic job, of which we have many.

If only Trump would do the same for the military; established "better protection" for Military Whistleblowers!!!

After reading this article, it hit too close to home, considering I was immediately ordered to be discharged from the Navy within weeks of filing a Qui Tam petition with the Department of Justice Anti-Trust division, in early June 2009.  I outline the details of my petition in the later chapters of my memoir, "Broken Silence, a Military Whistleblower's Fight for Justice, as well as ALL parties that were involved in defrauding our government!!

of innocent women and children;
bodies gasping for their last breath,
my heart weeps a somber cry for PEACE;

Why must mankind
continue to live in fear
of his own self-created,
self-perpetrated Evil?

Cardinal Sins committed
by his forefathers
he longs to commit,
long to prove himself to be
better than the last man standing
which is his ultimate destiny. 

The last man standing,
in his war against evil;
War against himself.
I shall not repent for
the sins mankind
committed in the past;
as were foretold by his
ancient scriptures,
his modern-day playbook,
his Evil script of life;
revealing how the story
will end, time and again. 

But what is there to learn
in his cycle of delusion
that Humanity would not
lift the Evil veil
to see through his fabricated
illusion of Good?

Good does not exist
in a heart cast from Evil.
Cast from a demonic possession,
cursed upon one who puts himself
above the Universe.

Only decayed flesh,
a rotted soul,
is the companion of misery. 

For I shall pray, giving thanks
to the Most High that I am able
to look Evil in his wicked eyes
to say, “There is still hope for you,

The Evolution of "non-Equal" Employment Opportunity in the US Military

As the momentum continues to build for victims of Military - Sexual Assault, Rape, and Sexual Discrimination, seeking fair justice in their Cause(s), you have to wonder, "Why haven’t the survived victims decided to “re-challenge,” the Defense Secretary for blatant Violations of their Civil Rights and Human Rights?!"

Nonetheless, they are members of a "Protective Class" and there is no statute of limitations for the heinous crimes committed against them.

As I near the 1-Year anniversary of WINNING my Pro Se Civil Action Case against the Secretary of the Navy, Raymond Mabus, for Retaliation, Sexual and Racial Discrimination; arguably Human and Civil Rights Violations, I was pleased to have set a legal precedent for each of the victims, should they ever decide to challenge the Armed Forces Secretaries for Whistleblower Retaliation, after reporting crimes committed against them, by their superiors, only to later become a victim of workplace retaliation, and other Civil Rights violations!!  

As ridiculous as it may sound, that you will be punished – should you encounter rape, sexual assault or discrimination – and decide to report the crime committed against you, only to become a targeted victim of more heinous crimes?!   Yes, we are living in a backward world!!

This was the unfortunate fate of thousands of military Veterans, who faced decades of ongoing Civil Rights violations.  During the early years of my Navy career, I witnessed brutal crimes committed against male victims of “sexual orientation discrimination," under the "Don't Tell," Era.   Thanks to President Obama for lifting the "Don’t Ask, Don’t Tell," military ban,  members of the LGBT community can now openly serve their country, without fear of reprisal or retaliation.  

When President Obama first repealed the “DADT Act,” I was facing discrimination issues of my own, but that chapter of my life is long past.  No need of dredging up the past if it no longer serves me for the purposes of "Good, or Fair and Equal Justice.”  Yet for the thousands of victims of sexual orientation and sex crimes, who have been able to have their military service records expunged, “I salute you!” for WINNING your Fight for Justice!!  And should the need arise to continue your legal battles outside the military, don't be afraid to challenge their injustices in the United States Federal District Court for the District of Columbia. 

As I move forward along my personal journey of Spiritual Healing,  I will offer our lawmakers one final bit of professional advice, “When you decide to champion the “cause” of  military Veterans, someone that has already been “Tried, Proven and Tested”, beyond the ability to “debate” the Constitution, and its Amendments, try putting yourselves in our shoes; feel our pain and suffering, and don’t use our issues as a competitive advantage over your colleagues or for lucrative financial gain!!”

Of all the Congressional members on Capitol Hill, very few speak from a Heart of Compassion.  Yet when I have a free moment away from my Spiritual meditation, to watch the ongoings around the DC beltway, the only Senator that seems to capture my attention for his compassionate Spirit is, Senator Bernie Sanders!!  Bernie always manages to warm my heart to remind me that there is still a Ray of Hope, and all it takes is one Mustard Seed to move a mountain.  Thanks, Bernie!!!  <3 <3 <3

Useful Information:

The Civil Rights Act of 1964 outlawed major forms of discrimination against African Americans and women, including racial segregation the act was later amended prohibiting discrimination on the basis of race, color, religion, sex, national origin, disability, or age, it also prohibits sex discrimination in the workplace.

Title VII of the CRA created the Equal Employment Opportunity Commission (EEOC) to implement the law, which is managed by the Secretary of Labor.

Unfortunately for military personnel, the Secretary of Defense was granted the authority to establish and manage the military’s Equal Employment Opportunity program, which is independent of the Secretary of Labor

After the passage of the 1964 CRA, President Johnson issued: 
EXECUTIVE ORDER No. 11246; September 28, 1965, 30 F.R. 12319 - EQUAL EMPLOYMENT OPPORTUNITY

Which states:


Section 101. 
It is the policy of the Government of the United States to provide equal opportunity in Federal employment for all qualified persons, to prohibit discrimination in employment because of race, creed, color, or national origin, and to promote the full realization of equal employment opportunity through a positive, continuing program in each executive department and agency. The policy of equal opportunity applies to every aspect of Federal employment policy and practice.

Sec. 102. 
The head of each executive department and agency shall establish and maintain a positive program of equal employment opportunity for all civilian employees and applicants for employment within his jurisdiction in accordance with the policy set forth in Section 101.

This law is pretty much null and void for military workplace abuse victims because senior military officials are granted executive authority to investigate themselvessimilar to the 1950 Feres Doctrine, which prohibits military veterans from being able to sue the federal government for negligence, even if they were abused by a superior and subsequently suffered from a disability as a result of their workplace abuse or medical malpractice.

"From Her Soul, I Speak, a collection of poetry"

As a gifted poet and Spiritual Medium, I lend my energy to the Great Divine, in return, I channel and transcribe Spiritual Messages to help Heal the Soul of Humanity!! 

"From Her Soul, I Speak," is my latest release to add to my nearly 600 piece collection. When I first embarked upon my Spiritual Awakening, I asked my mom, "What's happening to me?" as poems continuously flowed from my soul. Her response was, "We were born with 99.9% Free Will and the other .1% belongs to the Universe and she (the Feminine Divine) has "tapped" into your Spirit, you have no choice but to lend your "vessel" to her, as I and your father have throughout our lifetime. Imagine, at the age of 40, learning that both of your parents are Spiritual Mediums and that you inherited both of their gifts, as well as your own!! 

So far, it's been an interesting journey, considering the world we live in, full of HATE and CHOAS!!

As I begin my next collection, which I've already written several poems since the release of "From Her Soul, I Speak," I will continue to convey to the Great Spirit all that I bear witness to in this realm and transcribe her healing messages for the betterment of preserving Humanity. As the poems "flow from my soul," I will occasionally post them to my blog and forward to my Facebook page for those of you that are interested in her messages.
